These Order, Payment and Delivery Terms (the “Terms”) apply to each order at DeLaval.com (including sub-domains).
Order Process
Making an order at DeLaval.com (an “Order”) requires prior registration of a customer account and that the registered customer (the “Customer”) is logged in to its account. Customer places an Order to the single seller or service provider identified in the Order process at DeLaval.com (the “Supplier”), which is usually an entity in the DeLaval Group. The identified Supplier is independently liable for any goods, services or software supplied under the Order, unless otherwise explicitly agreed.
To make an Order, follow the steps indicated at DeLaval.com. In summary, start by selecting the items to be purchased by placing them in the “Cart”. The Cart can be opened and adjusted at any time and, after opening the Cart, Customer can also select to proceed with the Order. Before placing an Order, Customer will be given the possibility to review and edit the content of the Cart.
After placing an Order, Customer will receive an e-mail confirming that the Order has been received. When the Order has been processed, Customer will also receive an e-mail confirming that the Order has been accepted (the “Order Confirmation”) or an e-mail stating that the Order has been rejected or needs to be adjusted (e.g. due to an item not being available). The Order is binding upon the Order Confirmation. Until such Order Confirmation, Supplier may reject the Order and Customer may cancel the Order. Order cancellations can be made under “Orders” in Customer’s account at DeLaval.com.
Orders can be made only using the language(s) in which the applicable local version of DeLaval.com is provided. Concluded Orders will be available in Customer’s account at DeLaval.com for 5 years.
Payment and Credit check
Payment of Orders can be made using the payment methods specified in the Order process (currently: invoice). Payment upon invoice shall be made within 30 calendar days of the invoice date.
By registering at DeLaval.com, Customer grants Supplier and the other entities in the DeLaval Group (currently, the entities listed at http://www.delaval.com/legal/) the right to perform or request credit checks on Customer, and Customer acknowledges that Supplier may decline any Order if Supplier is not satisfied with the revealed credit status.
Delivery
Unless otherwise specified in the Order process, delivery of physical goods is made DDP (INCOTERMS 2010) to Customer’s registered delivery address. Delivery options and delivery charges are specified in the Order process. In general, Customer will be able to select either economy or express delivery (for some items, express delivery is not available). Express delivery is subject to a surcharge depending on the weight of the items to be delivered, as specified on the Order summary page. If an Order with economy delivery is below 200 euros (€200) in total (excl. VAT and delivery), a surcharge of 19 euro and 50 cents (€19.50) will also be added to the Order.
Before placing an Order, Customer will be presented with an estimation of the delivery time. An updated estimation may be provided at or before shipping.
Returns
Supplier accepts returns of purchased goods on the following conditions: (1) Returns shall be made within 14 calendar days of delivery; (2) Returned goods shall be unused, in the same condition as delivered, and in the original package; (3) Returns are not accepted for liners, dangerous goods, or when otherwise specified before the purchase; (4) Returns shall be made to the local address of the Supplier and shall, prior to shipment, be notified to Supplier by email; (5) Customer is responsible for shipment and associated costs; (6) Refunds will be made within 30 calendar days of the receipt of the returned goods.
Other terms
Each Order is subject to Supplier’s General Terms of Service and Supply, which are available for download and printing at http://www.delaval.com/legal/ (it is recommended to request or print copies for future reference). Customer is, in particular, made aware of the following provisions of DeLaval’s General Terms of Service and Supply: the retention of title (§ 3), and the provision that delivery dates and lead times are estimates (§ 4), the exclusion of retention and set off rights (§ 5) and the limitations of liability and exclusion of implied warranties (§ 9).
